1. Introduction

By using our website (https://radiantlyshineonline.com/) and services, you agree to comply with these Terms and Conditions ("T&C"). If you do not agree with any part of these T&C, please do not use our services. 2. Services Offered
Radiantly Shine Online provides digital marketing services, which may include:

  • SEO (Search Engine Optimization)

  • Paid Advertising

  • Lead Generation

  • Website Creation and Optimization

  • Strategic and Creative Marketing Consulting

  • AI-Powered Marketing Solutions

  • Social Media Management and Content Creation

  • Branding
     

Services may be delivered through consulting sessions, virtual or live events, recorded materials, and digital products. We reserve the right to update, modify, or discontinue any service at any time. In the case of active service agreements, we will communicate any significant changes in advance when applicable. Service changes do not entitle clients to refunds or compensation.

 

3. User Eligibility
By using our services, you confirm that:

  • You are at least 18 years old.

  • You are not violating any local laws or regulations by accessing our services.

  • You will provide accurate and complete information when requested.

  • You will not use our services for illegal, unethical, or fraudulent activities.

  • We reserve the right to refuse service at our discretion.

 

4. Pricing and Payments

  • Prices are listed in Canadian Dollars (CAD) before applicable taxes. International customers are responsible for conversion fees and local taxes.

  • Payments must be made in full before services begin, unless otherwise stated in a written agreement.

  • We accept payments via PayPal or other approved methods.

 

Chargebacks & Disputes:

  • Contact us first at info@radiantlyshineonline.com before initiating a chargeback.

  • Unauthorized chargebacks may lead to service termination and recovery of costs, including legal fees.

  • We reserve the right to challenge chargebacks and provide proof of service delivery.

 

5. Refunds, Cancellations & Disputes

 

Refunds:

  • Consulting & Events: Refunds are allowed within 48 hours of purchase, provided the session or event has not started and no preparation has occurred.

  • All Other Services (SEO, Ads, Social Media, etc.): Non-refundable once work has started.

  • Digital Products: Non-refundable once access is granted. Contact us within 7 days for technical issues.

  • Subscriptions: Cancel anytime; no refunds for current billing cycle. Access continues until end of billing period.

 

Cancellations:

  • Appointments must be canceled 48 hours in advance to reschedule. Late cancellations may forfeit the session without refund.

 

Disputes:

  • Email us at info@radiantlyshineonline.com with any concerns.

  • Allow up to 10 business days for resolution. If unresolved, both parties agree to consider mediation or arbitration before legal action.
     

6. Intellectual Property & Usage

  • All content on our website and in our services (text, visuals, materials) is our intellectual property.

  • You may not copy, sell, or reuse our materials without written consent.

  • Clients own marketing assets we create for them upon full payment. We may display non-confidential work in our portfolio unless you opt out in writing.
     

7. Limitation of Liability

  • We do not guarantee specific results (e.g., SEO rankings, ad performance, revenue growth, or business success). Individual results may vary.

  • Client outcomes depend on multiple factors including implementation and market conditions.

  • We are not responsible for lack of results due to incomplete implementation of our strategies.

  • To the maximum extent permitted by law, our total liability under this agreement shall not exceed the amount paid by the client for the specific service that gave rise to the claim.
     

8. Indemnification
You agree to hold harmless Radiantly Shine Online, its team, and affiliates from any claims, damages, or expenses resulting from:

  • Your use or misuse of our services.

  • Violations of any law or third-party platform policies (e.g., Google, Meta, PayPal).

  • Content you provide that infringes on third-party rights.

  • Legal claims arising from your use of our services
     

9. Client Responsibilities
To ensure effective collaboration and service outcomes, you agree to:

  • Provide timely feedback, access, and required information.

  • Cooperate with scheduled calls, reviews, and deliverables.

  • Refrain from delaying projects without notice.

  • Acknowledge that lack of cooperation may impact results.
     

10. Confidentiality & Data Handling

  • We treat all client data and business information with confidentiality.

  • We will not share sensitive information unless legally required or authorized in writing.

  • You agree not to share private strategy documents, proposals, or training content with third parties.
     

11. Third-Party Tools & Services

  • We may use third-party tools or platforms (e.g., Wix, Zapier, Google, AI tools) to deliver services.

  • We may also work with independent contractors, freelancers, or partner companies to help deliver our services. These collaborators are selected based on their experience and alignment with our quality standards. You acknowledge and agree that we may delegate work at our discretion, while remaining your primary point of contact.

  • We are not responsible for changes, disruptions, or failures in third-party tools, platforms, or subcontracted services used to support our work.

  • You may also be subject to the terms and conditions of third-party platforms or collaborators involved in delivering our services.
     

12. Force Majeure
We are not liable for delays or failure to perform due to events beyond our control, including natural disasters, internet outages, cyberattacks, government restrictions, or third-party service disruptions.

 

13. Governing Law & Jurisdiction
These terms are governed by the laws of Québec, Canada. Any disputes shall be resolved in the courts of Québec, district of Blainville.

 

14. Changes to These Terms
We may update these terms as needed. Changes will be posted with a new effective date. Continued use of our services after changes implies acceptance.
